Trump celebrates dismissal, calls for remaining cases to follow suit

Former President Trump on Monday celebrated the dismissal of the classified documents lawsuit against him and said all other lawsuits should follow suit.

“As we move forward to unite our nation after Saturday’s horrific events, the dropping of this lawless indictment in Florida must be just the first step, followed shortly thereafter by the dropping of the entire witch hunt,” Trump said. In a major victory for Trump, Judge Cannon ruled that Special Counsel Jack Smith was not lawfully appointed, marking the first time that one of Trump’s four criminal cases has been completely dismissed.

“The bottom line is this,” Judge Cannon wrote in his 93-page opinion. “The Appointments Clause is an important constitutional constraint arising from the separation of powers and gives Congress a deliberate role in determining the propriety of granting appointment power to subordinate officials.”

Cannon said that after “careful consideration,” he determined that there is no law that gives the attorney general the authority to appoint federal officials with the type of “prosecutorial power” exercised by Special Counsel Smith.

The decision comes just days after the former president was nearly assassinated during a rally in Pennsylvania, and both Trump and his presumptive rival in November’s presidential election have called for the nation to come together in the wake of the shooting.

Judge Cannon’s ruling comes as the Republican National Convention gets underway in Milwaukee, where Trump is expected to announce his running mate on Monday.
