‘Not Going To Happen’: CNN Legal Analyst Torpedoes Biden’s SCOTUS Reform ‘Wishlist’

CNN’s chief Supreme Court analyst Joan Biskupic said Monday that President Joe Biden is unlikely to enact his agenda for reforming the U.S. Supreme Court.

Biden on Monday proposed sweeping reforms to the Supreme Court. Suggest The Supreme Court’s proposals include term limits for judges, a “binding code of conduct” on ethics and reversing a ruling from earlier in July that granted immunity from criminal prosecution for “official duties” performed by the president while in office. CNN Newsroom’s Biskupic called Biden’s proposals a “wish list” and a “political document” that would never take effect. “These are very big proposals, and they’re also almost a wish list. This is primarily a political document because we’re going to take it at face value, but mind you, this isn’t going to happen,” Biskupic said. “Passing this is a big thing. First of all, he wants a constitutional amendment that essentially overturns the Supreme Court’s decision in June in the Trump case, which gave former President Donald Trump broad immunity from criminal prosecution. That case really shocked a lot of people, including the Biden administration. He wants a constitutional amendment to overturn that. This is a big push, and it needs the approval of 38 states. We haven’t had a new constitutional amendment since the ’90s.”

“He also wants term limits for judges. Currently, judges are appointed for life and the constitution provides for lifetime appointments,” she added. “He wants the president to appoint judges for 18-year terms. The president would essentially be appointing two judges for each presidential term. Again, this could only be implemented by constitutional amendment.”

Fox News legal analyst Greg Jarrett said Monday there is “zero chance” that Biden would impose term limits on Supreme Court justices, similarly noting that amending the Constitution would be “a very high hurdle.”

“And the third is something Congress can actually do, and that’s an enforceable code of conduct for judges,” Biskupic said. “President Biden has questioned not just judges’ rulings, but some of the judges’ conduct, like taking trips with wealthy individuals and not reporting them and some other issues involving Justice Alito and others, which fall into a different category of non-judge conduct, but what the first two address are actual rulings by the court.”

Vice President Kamala Harris, the presumptive Democratic presidential nominee, supported Biden’s proposals for the Supreme Court in a statement on Monday.
