On Tuesday, the U.S. 5th Circuit Court of Appeals ruled that Texas Maintains waterproofness On the Rio Grande River.
Last summer, in response to the Biden administration’s refusal to secure the southern border, Texas Gov. Greg Abbott (R) announced plans to erect a 1,000-foot-tall floating fence across the river, made up of linked, 4-foot-wide, spherical inflatable buoys that would rotate when grabbed to prevent people from climbing over.

Governor Abbott said he would install a water barrier at the heavily trafficked border crossing near Eagle Pass. The governor also installed barbed wire along the Rio Grande near Eagle Pass to further deter illegal crossings.
The Biden administration has entered a legal battle with Texas over efforts to stem the illegal immigration crisis, suing the state for erecting a barbed wire and buoy wall. The Biden administration’s Justice Department argued that Texas violated federal law by failing to get permits for the barrier. It also argued that the buoys raise environmental and safety concerns.
On Tuesday, the 5th U.S. Circuit Court of Appeals overturned a lower court’s injunction that had ordered the breakwater to be removed, ruling that it can remain in place for now. The broader case goes to U.S. District Court in Austin next week.
In response to the court’s latest ruling, Texas Attorney General Ken Paxton (R-Texas) Announced“The Fifth Circuit Court of Appeals ruled in favor of Texas, finding that a federal district court abused its discretion when it ordered Texas to remove floating buoys from the Rio Grande. The buoys deter aliens from illegally crossing the dangerous river to enter the U.S. illegally. The buoys can remain in the river. I will continue to defend Texas’ right to secure its borders from illegal immigration!”
Abbott called the court’s decision on Tuesday “justice.”
