A woman accused of dumping her newborn baby in a Houston trash can is in the United States illegally, authorities confirmed to Fox News Digital.
U.S. Immigration and Customs Enforcement (ICE) officials announced that on July 26, the ICE Enforcement and Deportation Office in Houston filed an immigration detention order against Everilda Cax Ajitharam, 18, at the Harris County Jail.
ICE confirmed that she is a Guatemalan national and entered the U.S. illegally as an unaccompanied minor after being arrested on suspicion of abandoning her child with no intention of returning home.
Prosecutors said Ajithram gave birth in a parking lot and then placed the baby in a tied-up garbage bag and left it in a dumpster, an act that was also caught on surveillance video, according to KPRC.

According to KRIV, officers from the Houston Police Department were called to the abandoned baby around 1:15 p.m. on Friday, July 26th, after a resident reported hearing crying coming from near the dumpster.
According to an affidavit obtained by KPRC, Ajitharam told police she gave birth earlier that morning outside the food truck where she works.
According to the affidavit, she then told police “she placed the baby, placenta and umbilical cord in a garbage bag, took the garbage bag to a trash collection site and left the baby in the garbage can with the baby still tied inside the garbage bag.”

Ajitharam later told investigators she “had no other choice” because she feared her boyfriend might break up with her, according to the report.
The newborn was immediately taken to Texas Children’s Hospital and has since been placed in the custody of Child Protective Services and is reported to be in good health.

Ajitharam made his first court appearance on Friday, where Harris County District Judge Veronica M. Nelson scolded him for leaving his son to die on a trash heap, The Houston Chronicle reported.
“It was sheer luck that the child was found and taken into custody,” Nelson reportedly said. “Given the fact that it was the middle of summer in Houston, Texas, and temperatures would have been dangerous for a child at the time, I am setting bail in this case at $90,000.”
Nelson later increased bail to $200,000.

Ajitharam is currently being held in Harris County Jail on immigration detention.
