Judge Merchan rejects Trump’s latest recusal effort, insists daughter’s political ties don’t pose conflict of interest

Tuesday, Acting Judge Juan Merchan Rejected This is Donald Trump’s latest attempt to have Judge Marchan removed from his role in a New York criminal case that is one of four indictments against the former president. It marks the third time that Trump’s legal team has asked Judge Marchan to step down.

Trump’s call for his resignation was based on the allegation that the judge had a conflict of interest due to the background of Judge Marchan’s daughter, Lauren Marchan, who works for a progressive political consulting firm whose clients include Trump’s political opponents. Trump’s legal team alleges that Judge Lauren Marchan benefited financially from a New York criminal case that her father presided over.

“New York is trying to steal the election!”

In her most recent decision denying the motion to vacate, Judge Marchan said Trump’s legal team “has not presented any new evidence for this Court to consider.”

The Trump campaign argued that Lauren Marchand’s relationship with Vice President Kamala Harris merited a recusal from Judge Marchand, especially now that Harris is running against Trump in the upcoming election. But the judge said the “alleged relationship” between the presidential candidate and “a member of our court’s family” was the “same allegation” the defense had already asserted in its two previous recusal motions.

Marchant said there was “no need to repeat the legal analysis” that was conducted as part of the original motion.

“For the third time, this Court repeats what should already be clear: insinuation or misinterpretation does not create a conflict,” Judge Marchan wrote in his dismissal. “Accordingly, recusal is not necessary, much less required.”

“The defense has merely repeated arguments that have already been denied by this court and by higher courts,” Marchan continued. “The defense’s reliance and apparent citations to its own prior arguments are riddled with inaccuracies and unsubstantiated assertions and serve no useful purpose.”

The House Judiciary Committee recently opened an investigation into Lauren Marchand’s father over possible conflicts of interest regarding his daughter’s work.

Meanwhile, Trump remains subject to Marchant’s gag order, which bars him from speaking publicly about court officials or their families, including Lauren Marchant.

Trump was convicted in New York in May of 34 counts of falsifying business records. Judge Marchan had previously agreed to Trump’s motion to postpone sentencing until September after the Supreme Court ruled on the former president’s immunity claim in a separate federal case.
