A federal appeals court on Monday blocked a lower court ruling that barred Florida from enforcing its ban on gender reassignment for minors.
In June, U.S. District Judge Robert Hinkle blocked the law from going into effect pending an appeal, but a 2-1 decision by the 11th U.S. Circuit Court of Appeals in Atlanta on Monday allowed it to go into effect.
“The law reinstated by the ruling prohibits prescribing puberty-suppressing or hormone-treating medications to transgender minors, even with parental permission,” it said. ABC News“It also requires that transgender adults may only receive treatment from a physician, not a nurse or other qualified medical professional. Adults seeking treatment must be in the same room as the physician when they sign consent forms.”
Florida argues that it does not seek to prevent minors from maintaining or adopting a gender identity, but only covers medical treatment for minors, such as “puberty-blocking treatments and sex-change hormones (e.g., administering testosterone to someone assigned female at birth).”
Minors who already received treatment before the law was passed in May 2023 will be allowed to continue their treatment while the surgeries are blocked.
