Former President Donald Trump continues to rack up legal victories against court battles engineered to undermine his presidential campaign, Trump lawyer Will Scharf explained during an appearance on The News. Breitbart News Saturday.
On Friday, Judge Juan Marchan postponed sentencing in the New York case until after the election – a lawsuit that could be dismissed on appeal – the latest in a series of impressive victories for Trump and his legal team.
“Since July 1st, when the Supreme Court ruled on presidential immunity, we've had victory after victory,” Schaaf told host Matt Boyle.
Scharf said the prospects for a conviction grow worse with each passing day since Trump's Manhattan business records conviction — one of the few silver linings for those trying to send him to prison.
“In New York, it was clearly the right thing to do to postpone the decision until after the election,” he said, adding that “the judge, realizing the gravity of the situation, realized this was not a job he could do.”
The victory is impressive given the volume of lawsuits, which have cost President Trump time and millions of dollars but have backfired in spectacular fashion by galvanizing the American people.
“As daunting as this legal battle against President Trump is, the sheer number of lawsuits, the number of cases being heard in various courts, I believe it's entirely accurate to say that President Trump is on a winning streak,” Schaaf said. “We've delivered major victories for him in courts across the country, and we'll continue to fight to ensure he has the chance to run for president unencumbered by this unconstitutional legal battle.”
Schaaf agreed with Boyle that Trump's court victories have upended Democrats' and the media's plans to keep him away from the campaign trail and spend much of his time in the courtroom.
“If you look back a year ago, it's clear that the original plan was to have him go through trial after trial throughout 2024: the D.C. case, the Florida documents case, the Georgia trash case and then of course the New York case,” he explained. “And fortunately, we were able to forestall that. He had to endure a sham trial in New York. But other than that, you know, he's been able to campaign and he's been doing well.”
Trump was able to get his message across to the American people and it was impossible to stop him.
“You know, every time he stands before the American people and delivers that core message that America is much better under his administration than it was under the Biden-Harris administration, voters are going to side with him,” Schaaf added. “So the question is, do we dismiss these lawsuits, as they did in Florida, or do we postpone these lawsuits, as they did in Washington, D.C., Georgia and now New York? … It's a question of fighting back at every turn.”
He says that underlying every element of this legal battle is a fundamental weakness in the charges against Trump.
“These cases look all great the day the indictments are filed because the prosecutors get in front of the cameras and talk about how strong their cases are,” Schaaf said. “What we've seen time and time again is that these cases are incredibly weak because President Trump has actually done nothing wrong. So as we've been able to challenge different aspects of these cases in court, the cases have collapsed.”
“It's a house of cards, and I think we'll see more of that in the coming months.”
The Supreme Court's ruling that Trump, and all presidents, enjoy immunity for official acts while in office further dashed Smith's lawsuits against Trump in Florida and Washington state. Despite threats from Democrats and the media, Schaaf says the law was on Trump's side and his team knew they could win.
“When we first filed our motion to dismiss seeking presidential immunity in the Washington lawsuit almost a year ago, every legal commentator and mainstream media outlet mocked it,” he said. “They said it was a Hail Mary. They said it won't work, that this is a totally crappy time-buying tactic. But we knew from the beginning that our legal argument was very strong. And as soon as the Supreme Court took up the case, I think the left collectively panicked, because at that point they realized that this legal fight wasn't going to have the impact they had hoped it would have on the presidential election.”
State Democrats across the country are said to be allowing or denying votes for their candidates based on whether having their names on the ballot will benefit or harm Trump, and in states like Michigan and North Carolina, Trump continues to successfully fight this new legal challenge.
“The left is desperate right now,” Schaaf told Boyle. “They're scared to lose, and they think they're going to lose, so they're playing legal games,” Schaaf added. “I think you're going to see a lot more wins in the coming weeks and months. I hope we can get this election clean. If we can get this election clean, if we can ensure that fair and unbiased rules are applied and that the Constitution and the rule of law are upheld, I am confident that President Trump will win in a landslide victory.”
Boyle asserted that Democrats will become more despairing as Election Day approaches, but despite the upcoming battles, Schaaf is confident Trump can continue his string of legal victories.
“I think this is the best team President Trump has ever led,” he argued. “I think it's a world away from 2020, when things were a lot more chaotic because of COVID-19. We're ready to fight. We're going to win the fight. It's just a matter of continuing to do what we're doing.”
