Tiger Woods may have to change the logo of his clothing company, Sunday Red, after Louisiana-based Tigerair Inc. rejected their trademark application.
Tigeraire started by creating a cooler, more comfortable helmet. LSU Tigers The company filed the filing on September 25, claiming that the Sun Day Red logo is similar to its own.
“The actions of SDR, TaylorMade, and Tiger Woods blatantly disregard Tigerair's long-protected marks, brand, and identity, violate federal and state intellectual property laws, and violate the consumer rights laws their actions cause. ,” the application states.
“SDR's application should be rejected.”
The application explains how the Tigeraire logo has been used continuously since August 2020. The United States Patent and Trademark Office (USPTO) approved its registration in 2022. The Tigeraire trademark covers products in the category of “Air Conditioning, Air Cooling, Ventilation Equipment and Appliances”. Electric fan. Personal electric fan. Wearable fan. Portable electric fan. ”
However, as Tiger Ale grew, it expanded its use of the registered mark to other products, such as apparel and cooling equipment available to golfers.
Sunday Red is a golf apparel company, and given that Woods has worn this logo at high-profile events such as the Masters and the U.S. Open, Tigerair has decided to take legal action to protect the brand. It was decided.
In response, TaylorMade, which supports Sunday Red, said: CNBC News“We have absolute confidence in trademark securitization.”
Woods, TaylorMade and Sunday Red have until November 4 to respond to the counter-notice. Woods must win a lawsuit against Tiger Air before it can trademark its logo, which features 15 tiger stripes representing his 15 major championships.
However, according to CNBC, the two sides will likely reach a settlement out of court beforehand. Whether that includes a logo change for Woods' Sunday Red brand remains to be seen.
