A New Mexico judge on Monday upheld the manslaughter conviction of a movie armorer in the shooting death of Alec Baldwin's cinematographer on the set of the Western movie “The Last.”

Judge Mary Marlowe Sommer ruled against Baldwin in July based on police and prosecutor misconduct and withholding evidence from the defense in the 2021 shooting death of cinematographer Halina Hutchins on a set outside Santa Fe. His trial was suspended and terminated.

Gutierrez-Reed was found guilty in March by a jury in a trial overseen by Marlow Sommer, who later sentenced him to up to 18 months in prison. Gutierrez-Reed already has an appeal pending in Superior Court against his manslaughter conviction.

Prosecutors accused Gutierrez-Reed of unknowingly bringing live ammunition onto the set of “The Last” and failing to follow basic gun safety procedures.
Gutierrez-Reed's attorney argued that her case should be reconsidered because prosecutors did not share potentially exculpatory evidence.

She was acquitted of charges of tampering with evidence during the “Lust” investigation. Gutierrez-Reed also pleaded not guilty to another felony charge for allegedly bringing a gun into a bar in Santa Fe, New Mexico, where firearms are prohibited. The proposed plea agreement awaits court review.

Baldwin, the lead actor and co-producer of “The Last,” was pointing a gun at Hutchins during rehearsals on a film set outside Santa Fe in October 2021 when his revolver went off, killing Hutchins and directing Joel Souza. I was injured.
