Former federal prosecutor Harry Litman says former U.S. Rep. Matt Gaetz (R-Fla.) will fail a background check for an entry-level position at the Department of Justice (DOJ), and President-elect Trump said Gaetz this week He was appointed as the head of the ministry.
Litman, a former U.S. attorney, argued that “thousands of experts” at the Justice Department could not be hired “if they were doing the things that Matt Gaetz is accused of doing.”

Gaetz resigned on Wednesday, hours after being selected by President Trump to head the Justice Department, following a multiyear investigation by the department. The investigation was concluded and no criminal charges were filed against the former lawmaker. He has repeatedly denied wrongdoing.
His selection to head the Justice Department has surprised Washington, with some Republican senators questioning whether Gates will ultimately be confirmed by the Senate.
Gaetz is also under investigation by the House Ethics Committee. The committee was scheduled to vote Friday on whether to release a report on allegations of illegal drug use and sexual misconduct against Gates, the people said. The committee canceled a meeting scheduled for Friday morning, but the fact-finding committee may release its report.
“I've never had someone so unqualified and had no prosecutorial experience, no legal experience, and that's the worst thing. Someone who actually comes to this department with contempt and hostility. It will cause a massive exodus,” Littman said. “This will cause judges and juries across the country to lose confidence in the Department of Justice. The credibility of the Department of Justice is its true stock and bargain.”
