3rd Circuit Rejects PA’s Motion to Remand Concealed Carry Case

On November 18, 2024, a three-judge panel of the U.S. Court of Appeals for the Third Circuit remands one of the Second Amendment Foundation's concealed carry policies for 18- to 20-year-olds. The state of Pennsylvania's motion was denied.

The three justices were Kent A. Jordan, appointed by George W. Bush, Luis Felipe Restrepo, appointed by Joe Biden, and D. Brooks Smith, appointed by George W. Bush. .

The denial of the motion to remand means the case will continue in the Court of Appeals.

Alan Gottlieb, founder of the Second Amendment Foundation, spoke to Breitbart News about the ruling. “This is an excellent decision by the Third Circuit Court of Appeals in the Second Amendment Foundation case,” he said. “Pennsylvania cannot delay the Court of Appeals from hearing and ruling on our case.”
