On Monday night, one of the judges, Federal Judge Embry Kidd of the 11th Circuit Court of Appeals, was confirmed as a Biden nominee over the objections of his home state senator, a presidential taboo.
Embry is accused of failing to disclose to the Senate Judiciary Committee two of his decisions to release child sex offenders before trial, decisions that were overturned by a district court. He also contributed a law review article criticizing the National Capital Child Rape Act as racist.

Despite the Republican absence, Democrats could have won the judge's confirmation regardless. Sen. John Fetterman (D-Pennsylvania) did not vote, but Mr. Schumer likely would have summoned him if a vote was needed.
The Senate Democratic Caucus currently has 51 members, with Vice President Kamala Harris able to vote in the event of a tie.
Republicans are doing everything they can to hold onto Biden's nominees, forcing Schumer to take time-consuming roll call votes during the Senate's daily business to buy time during lame-duck sessions. On Monday night, Republicans forced a roll call vote on motions that are routinely adopted unanimously, with Senate voting continuing until 10 p.m., well past most senators' bedtime.
There is little legislative work left in Congress this year, with the Senate expected to focus on fielding a large number of Biden's judicial nominees. Schumer added additional votes for attorney general nominees ahead of the Senate's opening over the weekend.
