Special prosecutor seeks dismissal of January 6 charges

special prosecutor Jack Smith asks judge to resign all charges against President-elect Donald Trump Fox News Digital has learned the charges stem from Smith's investigation into the Jan. 6 breach of the U.S. Capitol.

Judge Tanya Chutkan must approve the application before the case can be dismissed.

Mr. Smith also filed a motion to dismiss the classified records lawsuit against Mr. Trump, which was dismissed by federal Judge Eileen Cannon in July. Cannon ruled that Smith was illegally appointed special prosecutor.

The move comes after Smith signaled earlier this month that he would begin winding down the case against Trump following Trump's victory in the 2024 presidential election. The application was published on Monday afternoon in a Department of Justice document…Read more
