Merchan Revealing Sentence in Advance ‘Was a Scam, a Ploy’

On Friday on FNC's “Hannity,” Harvard Law Professor Emeritus Alan Dershowitz spoke about the New York State Supreme Court Justice's bid to prevent the Supreme Court from intervening in President-elect Donald Trump's record-keeping criminal case. criticized the apparent effort.

Prior to his sentencing on January 10, Marchan made it clear that prison time would not be part of the sentence for the president-elect. But Dershowitz speculated that the intent was to “persuade” the two high court judges not to take the case.

“What we saw today was a fraud, a ruse,” he said. “It started with Judge Marchan telling me in advance what the sentencing would be. I've been doing this for years. I've never heard from the judge what the sentencing would be. When I walk into the courtroom with my client, I wonder if I'm going home or not. I tell them to bring their toothbrushes because I don't know if they're going to another place of confinement. They are using that fact to dissuade them from filing a lawsuit.”

Dershowitz added, “And they said the reason we're not filing the case now and not proceeding with sentencing is because the judge said upfront that he wasn't going to sentence him to prison. ” he added. So it was a ruse, and unfortunately both judges fell for it. This is the worst thing to happen to America's criminal justice system since McCarthyism and the civil rights abuses of the 1950s and the sacrifice of American citizens. Trump, yes, it was tough, he was very honest that it was tough for him, but he won, he won, and he won because the American people rejected the law. You know, I invented the term legal issue in the 60's. I don't know if I'm proud of it or ashamed of it, I am. ”
