During oral debate Tuesday in an attempt to dismiss Smith and Wesson's $10 billion Mexican lawsuit, Judge Scotts Ketanji Brown Jackson suggested that the Mexican gun lawsuit would seek courts that Congress would not want.
In a transcription of oral discussion, Posted on Scotus' websiteJudge Jackson expressed concern that the lack of specific details in Mexican lawsuits actually strengthens Bolsters, which is actually a Congressional goal of protecting the gun industry through the protection of the Legal Commercial Act (PLCAA).
Jackson hinted at the PLCAA during his exchange with Mexican lawyer Katherine Stetson:
Stetson, I guess I'm worried. You spoke in response to Judge Kavanaugh what the PLCAA is and what it is getting, and as the decree itself says, at least in part, it refuses to avoid being concerned about Congress itself protecting its own privileges to regulate this industry. The legislative division of government.
She said, “I'm worried that complaints like yours don't have that clarity and that we really don't see how manufacturers are violating certain state or federal laws and that we are opposed to the very concerns that motivated this law.”
A little bit back and forth, Jackson noted:
So, when you see the lawsuit and what you are asking, if you are looking for changes to the firearms industry, safety practices, you say, you say, you know, you know, you know, you know, you know, what you should say is liability, distribution practices, distribution practices, marketing, everything you ask in this case raises everything you ask for, I ask for, I don't think about what I don't want to do with the court.
Breitbart News said Noel Francisco, a lawyer for Smith & Wesson, told Scotts Justice that Mexican allegations against gun manufacturers are similar to being liable for car accidents caused by minors' drinking.
