Democratic mayors Michelle Wu and Brandon Johnson were unable to expressly inform the chairman of the oversight committee on Wednesday whether James Kommer would hand over illegal immigrant criminals to immigrants and Customs Enforcement (ICE).
City in Boston, Chicago, New York City and Denver have not lifted longtime sanctuary cities, despite President Donald Trump's administration cracking down on arrests and deportation, particularly illegal immigration with people with criminal records. At Wednesday's hearing in front of the oversight committee, Comer was unable to obtain direct responses from Wu or Johnson. He repeatedly asked if he was willing to comply with federal law by handing illegal immigrants over the ice with their criminal history.
Comer cited the case in which an illegal immigrant raped his 14-year-old daughter and made her pregnant while she lived in a shelter for illegal immigrants.
“Would Mayor Wu hand over this offender to ice under Boston Act?” asked the Kentucky Republican.
“Whenever there is a criminal warrant, Boston police will enforce it and hold it accountable,” Wu said. “This happened outside of Boston, but I can tell you in town. Whenever someone commits a crime, whenever there is a criminal warrant, we are accountable to them. If ICE thinks it's dangerous enough to hold them, then get a criminal warrant and the Boston Police Department will enforce it.” (Related: “Sanctuary” city is making last ditch legal efforts to stay on federal grave trains after Trump's fundraising freeze)

Kommer said he considers the answer as “no.” The lawmakers then turned to Johnson and asked if they would take over illegal immigrants suspected of murder, temptation and sexual assault in 2024.
“Our local law enforcement agencies work hard every day to drive criminals out of the streets of Chicago,” Johnson said.
“Would you hand over this criminal over to the ice?” commer has been suspended. “That's one of the topics in this conversation. It's one of the issues I've heard from Tom Homan and Homeland Security. In your city, when someone is arrested for crime and ice, this new federal policy comes and wants to deport aliens from criminals you don't cooperate with on ice. Will you hand that criminal over to the ice?”
“We don't have criminals. Our local law enforcement agencies work hard every day to ensure that the city of Chicago is safe,” the mayor replied, leading Corner to repeat his question again. “Due to criminal warrants from the federal government, local law enforcement agencies have repeatedly worked with federal agents.”
The mayor of Chicago could not answer whether the offender should be handed over to the ice, but he would be “subject to” deportation on a criminal warrant.
The mayor who attended the hearing threatened not to comply with the Trump administration's immigration laws, including Democrat Denver mayor Mike Johnston in November, who said it would hinder deportation efforts. Border Emperor Tom Homan told Fox News' Sean Hannity that Johnston could “go to prison” if the ice prevents illegal immigrants from deporting him in his city.
Johnston later Backtrack His comments said they encouraged Denver residents to protest the Trump administration's immigration policy.
Wu fired from Homan as the immigrant community said it was “mischaracterized.” The border emperor said he oversaw the arrests of several criminals who committed violent crimes throughout Massachusetts. Among the many illegal immigrant criminals arrested in Massachusetts, Ice arrested members of the Haitian gang after 17 prior convictions on January 23.
The border emperor said nine illegal immigrants arrested for child rape in Massachusetts were released on the streets rather than handed over to the ice when they appeared at the Conservative Political Action Council (CPAC). In June 2024, a 24-year-old illegal immigrant from Guatemala was released on state bail after being arrested for raping a child in Bristol County.
Attorney General Pam Bondy has announced lawsuits against Illinois and New York over alleged violations of federal immigration law.
