A federal judge temporarily blocked the Trump administration on Saturday from calling out the alien enemy law of 1798, preventing the removal of undocumented immigrants in Venezuel, presumably members of Tren de Lagua's gang.
The order issued by US District Judge James Boasberg will suspend deportation of all individuals deemed entitled to 14 days under President Trump's declaration, as a result of a lawsuit filed by the Democratic Forward and the ACLU.
“I think there's obviously irreparable harm here given these people being deported,” Boasberg said during a virtual hearing.
“The short delay in their removal will not cause any harm to the government,” said Boasberg, president of President Obama.
But in the phone, Boasberg shows that some of the five Venezuelans who were detained over the weekend are already repatriated flights.
Earlier in the day, the judge blocked the removal of five Venezuelans before Trump decided to formally call the AEA.
“A plane that either takes off or includes these people in the air will need to be returned to the US,” Boasberg told Department of Justice officials.
