In response, the Department of Justice (DOJ) subsequently filed a notice of appeal with the U.S. Court of Appeals for the District of Columbia.
On Wednesday, Ana Reyes, appointee of Washington, D.C.-based US District Judge Joe Biden, denied allegations to resolve the government's order.
The judge presided over the hearing held on March 21st.stwhen she demanded that the Department of Defense (DOD) delay the original March 26thth The deadline for establishing a policy.
Reyes argued that the Department of Defense's justification for the ban was based on “pretends and anti-trans policies.” However, the submission also argued that the policy is not a comprehensive prohibition and “does not identify anyone who identifies gender discomfort (a condition) as a class.”
Additionally, the Trump administration has requested that if the dissolution motion is denied, the court must maintain a pending appeal of interim injunction. Fox News It has been reported.
Without an ongoing conflict, the administration said in a new direction released on March 21.st Policies are expected to be implemented. This guidance revealed that “sys consistent with the phrase “gender discomfort”” applies only to individuals who exhibit symptoms that are sufficient to constitute a diagnosis.”
Judge Reyes said he wanted to give the appeal process more time. She also argued that she had already given her ample opportunity to challenge previous rulings that prevented the ban from being enacted.
In response, the Secretary of Defense facetically suggested that Reyes should begin reporting to US military bases, as she is clearly “now the top military planner.”
“As “Judge” Reyes is now a top military planner, he can report to Fort Benning in 0600 and instruct the Army Rangers how to carry out a high-value target raid.
Reyes confirmed on Wednesday that the military's identification guidance (MIDI guidance) is new, but the arguments presented by the defense are not.
“The defendants re-emphasize their “consistent position.” [Hegseth] Policy has to do with military preparation, deployment and costs associated with medical conditions,” the judge wrote. The military ban regulates medical conditions and claims not people. And there's the problem there. ”
“Gender discomfort is different from other medical conditions and is well known to the accused,” Reyes continued. “It affects only one person. Everyone with gender discomfort is transgender, and only transgender people experience gender discomfort.”
Despite the judge's comments hinting that gender discomfort (transgender) will suffer from the rest of their life, the National Institutes of Health (NIH) published a study in 2022 that stated: Depression disorder (70%), anxiety (63%), post-traumatic stress disorder (33%), attention deficit disorder (24%), autism spectrum status (20%), eating disorder (19%), and personality disorder (17%).
In the military, mental health assessments are important to ensure preparation and well-being, often including screening for conditions such as depression, as well as assessing suitability for services. It is important that our service members in the US are mentally healthy.
Nevertheless, the judge acknowledged that the case has generated a massive discussion on the issue.
“This is all good,” Reyes said. “But let us remember that our service members are making discussion and appeal possible. Their sacrifice brings life to the phrase “one nation under God, inseparable, with freedom and justice for all.” The court once again thanked them. ”
