A retrial of the death of Karen Reed’s Boston Police Officer’s boyfriend, John O’Keefe, kicked off almost immediately with expected fireworks on Tuesday. And continued after Judge Beverly Canone sent the day’s ju apprentice home in a fierce hearing with a late discovery disclosure.

Defence counsel Alan Jackson opened up to challenge the prosecutor’s litigation center.
“The evidence in this case would establish three points above all else,” he said. “We had no conflicts with John O’Keefe. There were no conflicts. There were no conflicts.”

Special Counsel Hank Brennan told another story in his own opening statement a few minutes ago, saying that he was drunk and angry by the ju-decided, deliberately hit the gas and plunged O’Keefe with his back bumper before leaving him on the ground.
In either case, it may depend on whether a pair of defense experts are allowed to testify about their conclusions.

After the ju judge left, the sides discussed in a fierce movement, hearing whether expert testimony from the ARCCA Crush Reconstruction Company should be permitted.

Two experts from the company testified at the first trial and challenged the prosecution’s version of the event.
Brennan told the judge that the prosecutors noticed additional conclusions from experts. The new information is that his team doesn’t have time to properly prepare because there is no disclosure.

Defence counsel Robert Alessi said it was Brennan’s team who caused the delay in discovery by revising expert disclosures in March.

“In previous hearings I discovered that I had breached my mutual discovery obligations of defense,” Kanon said. “It is clear to me and I have found it intentional. This, contrary to what you all claimed, Mr Alessi, is, this is another violation of my order and mutual discovery violation. We must understand all this before you are permitted to call these witnesses.”
To achieve that, she ordered voir’s miserable hearing with ARCCA experts on Friday morning. There are no ju judges all day.
Essex County trial lawyer Grace Edwards said he was following the case but that the hearing at the end of the day left her on the floor.
“They don’t have a video of Sallyport yet,” she said. He mentioned Reid’s defense and police surveillance footage from the day her SUV was first locked up. “They hid the video. This feels harsh.”

As Brennan had previously asked Canon to rule out the ARCCA team, Edwards predicted that new testimony expected by the ARCCA could be problematic for the Commonwealth.
“She barely allowed this, she can’t be satisfied with this,” said Paul Mauro, a former NYPD inspector who has followed the case. “Very bad news for defense.”
When she met a reporter outside on the court stairs, what she read seemed to be against.
“It feels good,” she said. “It worked fine today. We prepared very hard. I’m proud of my team.”

When asked why Jackson didn’t start his opening statement last year as David Jannetti did last year, she replied that he told the ju-described “framed,” “We don’t like to rerun.”
The first to stand up was a witness to paramedic Timothy Nutter, who checked O’Keefe when the ambulance arrived at the scene at about 6am on January 29, 2022.
He testified that while the first responder was about to give him an O’Keefe CPR, he said, “I hit him. I hit him. I hit him.”

However, during cross-examination, Jackson quickly questioned Nuttall’s memory. At Read’s first trial last year, Read testified that he only said the phrase twice.
He also confronted Nattoll with his own testimony about what O’Keefe was wearing. He then played a video of the paramedic dash cam at the scene and asked him to walk around it, pointing out where his testimony was not lined up with the ones on screen.

Nat sometimes looked uncomfortable as Jackson repeatedly wondered about his memories, his previous testimony, and the timeline of his events. However, he claimed he heard what he read, saying, “I attacked him.”

The second witness was Kelly Roberts, a friend of O’Keefe, whose son was the same age as his adopted son. She grew up with the victim, but she said they approached after adopting her younger sister’s orphan child following the family tragedy.
Roberts was one of those called on the morning of O’Keefe’s death.
She said she was driving Jennifer McCabe reading while she was searching for him that morning. After searching his house for the first time and leaving him empty, they went to Albert’s house. There, the night before, McCabe and other friends and acquaintances were going to an afterparty.
