Indiana Middle School is facing a civil rights complaint over a “racially exclusive” teacher hosted for some students in its class.
A sixth grade teacher at Tippecanaw Valley Middle School in Akron, Indiana, reportedly held the party exclusively with Hispanic students in January, according to a complaint filed Friday with the U.S. Department of Education’s Department of Civil Rights (DOJ) Office of Civil Rights in January.
“The school has restricted the privilege of attending a party celebrating Dear de los Reyes Magos or the Three Kings Day during school hours, despite claiming that the school loves to embrace cultural traditions,” said the Wisconsin Liberty Institute’s complaint (Will), a conservative legal group. “The school separated children by race, ensuring that people from the ‘right’ race enter the celebration room. Tippecanau Valley Middle School did not respond to requests for comment.

According to Will’s screenshots, the school celebrated the teacher’s party in a Facebook post on January 24th.
The teacher responded to parental complaints by explaining that “special care is needed to help children separate from the class to celebrate their heritage and to make a marginalized society feel inclusive.” The school deleted the Facebook post after parents raised concerns to the principal, according to the complaint.
“Pupils were excited to celebrate the culture in the classroom. It was tough to keep the excitement (and noise levels) under control!” Posted. “It was an absolute joy to see them celebrate with pride on behalf of their families and traditions.”

“Brown v. Board of Education made that clear: racism in public schools has no place in America,” Lauren Gruel said in a statement. “The Civil Rights Act of 1964 reaffirms the truth and prohibits discrimination based on race across the country. But today, the school violates both. We urge the Civil Rights Office and the Department of Justice to launch a prompt and thorough investigation into these serious federal law violations.”
Race-based programs at universities and businesses have been the subject of civil rights complaints and litigation following the decision to break the Supreme Court’s positive actions. Since taking office, President Donald Trump has also signed several executive orders targeting federal government diversity, equity and inclusion initiatives.
