Elon Musk’s lawyer claims that OpenAI’s restructuring plan has no real impact.

Elon Musk’s legal team argues that OpenAI’s recent decision to partially alter its plans for restructuring as a for-profit entity suggests continued legal challenges from wealthy stakeholders in the AI sector.

In a statement issued late Monday, Mark Toberov, Musk’s primary attorney in an ongoing lawsuit against OpenAI, criticized the updated restructuring strategy, labeling it a “transparent dodge” that fails to resolve the core issues. Earlier that day, OpenAI revealed its intention to maintain its for-profit development as a public benefit entity while keeping overall control with its nonprofit arm.

This choice to retain nonprofit control follows a tumultuous decade for OpenAI, which has faced significant pressure from multiple parties, including Musk—who co-founded the organization before pursuing his own AI projects. Musk had sought a court order to stop OpenAI from transitioning into a commercial enterprise, but the judge declined his request, although some of his legal actions will proceed. Furthermore, Musk has not succeeded in his attempt to acquire the nonprofit that oversees OpenAI for $97.4 billion.

Toberov contended that despite the restructuring updates designed to avoid legal scrutiny, OpenAI deviates from its foundational goal of advancing AI for the public good. “The original mission is still being undermined,” he stated, adding that the charity’s assets will ultimately benefit Altman, his investors, and Microsoft.

The ongoing legal confrontation between Musk and OpenAI underscores the tensions and intensifying competition within the fast-evolving AI landscape. As various tech firms and startups vie to create and utilize advanced AI systems, concerns surrounding governance, ownership, and the wider societal effects of such technologies have become increasingly pressing.

While OpenAI’s continued nonprofit status may alleviate some worries about the concentration of influence and wealth, Musk’s legal team seems intent on persisting with their challenges against the organization’s actions.
