Woman Declared Brain-Dead Required to Carry Baby to Term Due to Abortion Laws in the US

Georgia Woman on Life Support Amid Abortion Law Controversy

Adriana Smith, a 30-year-old woman from Georgia, has been on life support for three months after being declared brain dead, which has sparked a complicated situation due to existing abortion laws. Her mother, April Newkirk, shared that Smith was declared brain dead in February following a medical emergency. The family was informed by doctors that they couldn’t discontinue life support due to the state’s strict anti-abortion legislation.

This legislation, known as the “heartbeat law,” restricts abortion when cardiac activity is detected, typically around six weeks into pregnancy. Newkirk mentioned that Smith is currently 21 weeks pregnant and that removing life support would most likely lead to the fetus’s death. “She’s pregnant with my grandson, but he’s blind, can’t walk, and may not survive if born,” Newkirk expressed, voicing her concerns about the potential ramifications for her grandson.

This family’s struggle highlights the challenges and uncertainties of Georgia’s abortion ban, which grants personhood rights to the fetus. Proponents believe that fertilized eggs, embryos, and fetuses should have the same rights as living individuals. Republican Senator Ed Setzler, who sponsored the law in 2019, endorsed this view, stating, “I think it’s perfectly appropriate for a hospital to do what it can to save the lives of a child.”

On the other hand, Monica Simpson, the executive director of Sistersong—a national organization advocating for reproductive justice for women of color—stated, “Her family deserves the right to make decisions regarding her medical care. Instead, they have faced more than 90 days of emotional turmoil, soaring medical costs, and the harsh reality of not being able to make a choice.”

The law has faced criticism for its potentially tragic outcomes. Two Georgia women, Amber Thurman and Candy Miller, reportedly died after using abortion medication, not receiving adequate care for complications that arose. Their deaths are often cited as cautionary examples of the devastating effects of the abortion ban. Vice President Kamala Harris pointed to this issue as stemming from abortion restrictions that have taken effect in Georgia and elsewhere following the Dobbs decision.
