Legal Challenge Over Aliens Held at Guantanamo Bay
Ten undocumented immigrants are currently facing transfers from Texas to a facility at the U.S. Navy Base in Guantanamo Bay, Cuba. A lawsuit was filed against the Trump administration on March 1st, claiming that the transfers were “arbitrary and whimsical,” thereby violating the Administrative Procedure Act, the First Amendment’s due process clause, and the Immigration and Nationality Act. The plaintiff, backed by the American Civil Liberties Union, has asked for a stay on the transfers.
Since then, seven of the plaintiffs, including Espinoza Escarona, have taken steps to withdraw from the case. Escarona, identified by the Department of Homeland Security as associated with the Venezuelan terrorist group Tren de Aragua, is among those who no longer wish to pursue the lawsuit.
Christa Noem, the Secretary of Homeland Security, is named as the defendant in this case. In response to the voluntary dismissal of the lawsuit, she simply stated, “Suck it.”
This comment sparked a variety of reactions online. Some praised her for being direct, while others, especially on the left, called her remarks “cruel,” “classless,” and “strange.”
One reaction expressed, “How evil it fell.”
Alex Howard, formerly with the Biden administration’s DHS, remarked that Noem’s handling of this situation could take years to reverse, hurting the agency’s reputation.
Aaron Reichlin Melnick, a Senior Fellow at the American Immigration Council, also voiced concern about Noem’s statements, underscoring that the account belonged to the U.S. Department of Homeland Security.
Another commentator remarked on social media, expressing disbelief over the official tone, saying “This is real.” Several individuals have conveyed that Noem’s message reflects a dangerous attitude regarding deportations.
The plaintiffs withdrew their case “without prejudice,” meaning they could potentially refile it later. However, government lawyers argue that the plaintiffs lacked standing to contest the lawsuit, asserting the court doesn’t have jurisdiction over discretionary acts involving the transfer of undocumented immigrants. Additionally, Noem is asserted to have legal authority to transfer detainees to Guantanamo.
Trump previously stated, “We are extremely grateful that they are on the streets of the United States and that we have a safer community.”
On January 29, Trump directed Noem and Secretary of Defense Pete Hegseth to take necessary actions to expand the Guantanamo Immigration Operations Center to provide more detention space for “priority criminal aliens” present illegally in the U.S.
The Pentagon has since set up a Southern Guard task force to work alongside DHS to execute Trump’s directive. U.S. officials have noted that around 70 undocumented immigrants are currently held at Guantanamo.
Noem previously remarked on CNN that the individuals being transported to Guantanamo are among “the worst we’ve pulled from the streets,” describing them as serious offenders, including murderers and child traffickers.
She mentioned ongoing plans to accommodate up to 30,000 detainees in total.
