On Wednesday, US District Judge James Boasberg directed the Trump administration to facilitate the return of non-citizens who have been deported to El Salvador’s major security prison. This order hinges on regulations that date back to 1789 involving the deportation of certain migrants.

In his ruling, Judge Boasberg emphasized the government’s obligation to allow these individuals the opportunity to seek legal recourse against their deportation. He acknowledged that while the courts must respect certain sensitive diplomatic and national security issues, there exists a constitutional duty to provide justice for those affected.

The specific case cited includes that of Kilmer Armand Abrero Garcia from El Salvador, who reportedly has ties to MS-13. He had been deported from Maryland back in March due to what administrative officials later recognized as a mistake. This situation has intensified legal battles, even urging intervention from the Supreme Court in April.

Background on Judge Boasberg’s Involvement

Earlier this year, Judge Boasberg gained attention for issuing a critical emergency ruling against the Trump administration, blocking immediate deportations under the 1798 law that included individuals from Venezuela, alleged members of a violent gang known as Tren de Aragua.

He also mandated that any planes transporting migrants deported under this law should return them to the US “promptly,” though this directive was not followed through. Currently, the Trump administration faces various lawsuits concerning deportation flights enacted under the alien enemy statutes from March.
