Supreme Court supports Texas law mandating age checks for accessing adult websites

Supreme Court Upholds Texas Age Verification Law for Porn Websites

The U.S. Supreme Court has affirmed that Texas laws requiring age verification on pornographic websites are constitutional, with a ruling of 6-3. The law, known as HB 1181, mandates that certain websites featuring explicit content must verify that users are at least 18 years old.

In the court’s opinion, penned by Justice Clarence Thomas, the ruling emphasizes states’ rights to limit minors’ access to sexually explicit materials.

“The ability to require age verification falls within a state’s powers to shield children from adult content. HB 1181 is a constitutionally valid exercise of that authority,” Thomas articulated in the decision.

He further explained that the law does not directly regulate adult speech, stating, “It merely requires age verification to prevent minors from accessing inappropriate content.”

Justice Elena Kagan, joined by Justices Sonia Sotomayor and Ketanji Brown Jackson, voiced dissent. Kagan argued that restricting minors’ access inadvertently limits adults’ rights protected by the First Amendment.

“The majority asserts that Texas can enforce this law under interim scrutiny, which doesn’t adequately assess whether the state has implemented all possible measures to limit voice restrictions,” Kagan noted.

She added, “Based on established First Amendment principles, if a measure isn’t necessary, it shouldn’t inhibit adult access to protected speech.”

This case reached the Supreme Court following a lawsuit by the Free Speech Union, an organization representing pornographic websites, against Texas Attorney General Ken Paxton.

Following the ruling, Paxton expressed support, highlighting it as a significant move towards safeguarding minors from explicit online material.

“This is a major victory for children and parents, reinforcing our nation’s commitment to shielding minors from the damaging impact of online pornography,” Paxton remarked. “Companies must implement responsible age verification processes. I will continue to uphold the law against entities that fail to protect minors from explicit content.”
