High Court Supports Texas Law Mandating Age Checks for Adult Websites

Supreme Court Upholds Texas Law on Age Verification for Porn Websites

The U.S. Supreme Court confirmed its support for a Texas law mandating pornographic websites to verify user ages, voting 6-3 in favor.

Justice Clarence Thomas wrote the majority opinion, while Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson were in dissent.

Thomas asserted that the state has the authority to mandate age verification to prevent children from accessing explicit content. He pointed out that while Texas, like many other states, prohibits minors from seeing sexually explicit material, enforcing this regulation online poses substantial challenges.

This led to the 2023 enactment of HB 1181, requiring porn sites to ensure that users are verified as adults.

Thomas described this requirement as a necessary legal measure to safeguard children from inappropriate content. He emphasized that it aligns with a state’s duty to protect minors from such exposure.

He added that users could verify their ages using methods like providing government IDs or transactional data.

The law’s supporters expressed concerns over minors having access to explicit content, including depictions of violence and sexual acts that could be harmful.

Critics, however, argued that this legislation could infringe on the First Amendment rights of adult users. Despite these criticisms, the majority of the justices contended that the law does not prevent adults from accessing adult content; it simply requires verification first.

Thomas acknowledged that while the law might create barriers for adult visitors, they still retain the right to view such material.

He noted that the court is tasked with evaluating whether these requirements might render HB 1181 unconstitutional under free speech protections.

Additionally, the law mandates reasonable age verification methods for commercial entities distributing material online, aiming to ensure that anyone trying to access such content is at least 18 years old.

Thomas further stated that violations could result in legal action by the Texas Attorney General against those noncompliant with the law.

He pointed out that Texas isn’t alone in implementing such measures, referencing at least 21 other states that have enacted similar age verification requirements for accessing harmful content.

In early 2023, lower courts had temporarily halted Texas law, with a district judge granting a preliminary injunction just before the law was set to take effect.

A representative for Iro, the parent company of PornHub, expressed satisfaction with the Supreme Court’s ruling.
