Understanding the reasons behind Navvis & SSM health lawsuits

Navvis & Company partners with healthcare providers like SSM Health to manage population health. The settlement arose from legal actions connected to a data breach that occurred between July 12th and July 25th, 2023. This breach allowed cybercriminals to access personal information of customers associated with Navvis & Company.

Not only SSM Health patients were affected; members from Arkansas Health Network, Horizon BCBS of New Jersey, Allina Health, RWJBH Corporate Services, and Florida Medical Clinic were also compromised. Notifications about the data breach began to be sent out in September 2023, with the last batch dispatched by June 2024.

Although six separate cases were initiated due to these breaches, they fall under the same title: DOE, et al. v. SSM Health Care Corporation, et al. The lawsuit claims that Navvis and SSM Health showed negligence by not implementing adequate cybersecurity measures to fend off such violations.

Though Navvis and SSM Health have refuted the fraud allegations, they consented to a $6.5 million settlement to deal with the repercussions of the 2023 data breaches.

Eligible class action members can receive a portion of the settlement—possibly up to $7,000. According to the agreement, claimants might receive:

  • Up to $2,000 for normal losses, stemming from the data breach. This includes expenses like bank fees, communication costs, credit monitoring fees, and travel expenses.
  • Up to $5,000 for extraordinary losses, which may arise from issues like identity theft and fraud-related financial losses.
  • Cash payment ratio. Those who had their information exposed but did not incur direct costs from the breach will receive a pro-rata payment after administrative fees and claims are considered.

Claimants seeking extraordinary losses will need to submit relevant documentation, such as proof of loss or expenses incurred. Additionally, claimants will get free credit monitoring services for two years. Although the deadline for claims related to a different data breach has passed, there’s still an opportunity to file for the Navvis breach.
