Appeals Court Overturns Conviction of Pro-Trump Influencer

An appeals court has overturned the conviction of a pro-Trump influencer who was accused of disseminating false information on social media to reduce voter turnout among Democrats during the 2016 election. This ruling nullifies the conspiracy charges and the associated federal prison sentences decided by a judge in Brooklyn, New York.

The US Court of Appeals for the Second Circuit unanimously decided on Wednesday to reverse Douglas Mackey’s conviction and remand the case back to the US District Court in Eastern New York.

A panel of three judges stated in their ruling that a reasonable juror might not have found sufficient evidence to prove that Mackey knowingly participated in an illegal conspiracy to influence the election or prevent individuals from voting.

The judge, Debra Anne Livingston, emphasized that the original verdict and ensuing conviction must be dismissed.

This revelation is a notable win for Mackey, a self-identified right-wing influencer who gained about 58,000 followers on Twitter during the early phases of the 2016 election.

The three-judge panel noted that the government failed to demonstrate that Mackey had intentionally collaborated with others to carry out such plans. As a result, they decided to overturn the conviction.

Mackey expressed his relief and joy through a social media post shortly after the ruling. He exclaimed “Hallelujah!” and thanked God, his family, and legal team for their support. He also hinted at potential legal actions regarding his beliefs moving forward, stating, “Now we sue.”
