A Marine hopeful from Oklahoma was found dead alongside a road, prompting a new lawsuit alleging wrongful death. Nineteen-year-old Noah Presgrove was at Labor Day celebrations with friends before his body was located on September 4, 2023, in Terral on US Highway 81. Nearby, authorities discovered some of his belongings, including teeth, necklaces, and basketball shorts.
Initially, officials thought Presgrove might have been struck by a car after leaving the party. However, a lawsuit filed on June 23 claims his death wasn’t caused by an automobile. The legal action seeks at least $75,000 in damages. Fox News Digital has reached out to the plaintiffs’ attorney for further comment.
According to the lawsuit, the party took place on property owned by Johnny Trout Wilcoxon Jr. with a trailer belonging to Stevie Howard. At the time of writing, some defendants didn’t have legal representation, and none had responded to the lawsuit. Andrew Benedict, the lawyer for Wilcoxon and Howard, has not provided a comment.
It’s reported that Jack Newton, another defendant, who is under 21, allegedly bought alcohol from a convenience store prior to the events. Noah’s blood alcohol level was found to be about twice the legal limit at the time of his death.
The lawsuit hints that Presgrove drank at a house party where he was later involved in an ATV rollover incident. Despite his intoxication, he was reportedly allowed to ride on the ATV. The conditions at the scene were dark, and no vehicle debris was found. Further examination suggests he attended the party and left before being discovered the next morning.
Details reveal that he returned to the gathering after the ATV incident and was last seen conversing with Howard and Newton around 3:41 a.m. on September 4. Prosecutors concluded that he died from blunt force trauma affecting his head, torso, and limbs.
The complaint alleges negligence and civil conspiracy, holding the defendants accountable for their roles in Presgrove’s death. With plans to join the military, just months after graduating high school, his family continues to seek answers regarding the circumstances surrounding his tragic passing.
