Selection Process for High-Stakes Murder Trial Underway

The jury selection process commenced on Monday for dentist James Craig, who is facing serious charges in connection with the death of his wife, Angela Craig.

James Toliver Craig, aged 47, stands accused of first-degree murder after his wife passed away in March 2023. An autopsy revealed that she died from lethal amounts of cyanide and tetrahydrozoline.

Defense attorney Kelly Hyman discussed the expected challenges as Craig’s trial progresses.

Led by Lisa Fein Moses, the defense has already sought to challenge key aspects of the prosecution’s case, including motions to dismiss certain electronic evidence and accusations, setting the stage for a contentious legal battle.

“Evidence plays a critical role in any trial, and significant motions often arise to limit what can be used against the defendant,” Hyman noted.

This motion to suppress evidence is a tactic often employed in criminal cases to keep potentially harmful information from being presented.

“The defense typically argues that the evidence was obtained illegally or that it violates the defendant’s rights,” she added.

Craig, a dentist in Aurora, Colorado, is reportedly under investigation for using a computer at his clinic.

Authorities revealed that no hidden email accounts were discovered on Craig’s or Angela’s devices, and suspicious searches were only conducted on a work computer in Dental Examination Room No. 9.

In the weeks leading up to Angela’s death, investigators claim Craig used the clinic’s computer to look up “undetectable poisons” and how to acquire them, including inquiries on the lethal effects of arsenic and cyanide.

Moreover, Craig reportedly conducted YouTube searches for information such as “How to Make Poison” and “Top 5 Undetectable Poisons That Do Not Show Signs of Foul Play.”

Hyman pointed out that defense claims suggesting these searches exceed the search warrant have already been dismissed by judges.

Still, it’s expected that the defense will persist in questioning the validity of various pieces of evidence put forth by the prosecution, including audio recordings between Craig and an extramarital partner.

Hyman emphasized the importance of the upcoming legal arguments over forensic evidence.

She anticipates that a “gatekeeping” hearing will be held to assess the reliability of scientific evidence like toxicology reports and digital forensics.

“The Chain of Custody Documents and Lab Accreditation Standards will play a crucial part in this trial,” she explained.

Hyman also touched upon how media coverage could influence trial proceedings. Prosecutors have suggested that defendants might reinforce their positions to counter public perceptions, particularly when considering the option to change venues.

“Under these circumstances, both sides feel significant pressure, knowing that potential jurors may already be influenced by media reports,” she remarked.

She noted that once jury selection begins, potential jurors must be examined for their news consumption and views on law enforcement.

“It’s important to remember that a person who claims to be impartial may still have preconceived opinions shaped by sensational headlines,” she stated.
