Prominent attorney Alan Dershowitz and Fox News legal analyst Greg Jarrett said Friday that Special Counsel Jack Smith used “intimidation tactics” against U.S. District Judge Eileen Cannon.
Cannon, a Trump appointee, rejected efforts by former President Donald Trump’s lawyers to drop charges in Trump’s classified documents case under the Presidential Records Act, but submitted documents before the ruling. He also criticized Mr. Smith for his tone. Jarrett noted that Smith had used “heavy-handed tactics” in previous incidents. Jarrett told Fox Business host Larry Kudlow, a former Trump administration official, “He’s been railroading defendants by just punishing them and revoking them, and now he’s using the same intimidation tactics as Judge Cannon.” “I’m doing it,” he said. “He demanded that she accept proposed jury instructions that excluded the Presidential Records Act, Mr. Trump’s main defense, and even tried to terminate her case if she did not surrender.”

In June, a federal grand jury handed down a 37-count indictment against Trump based on an investigation into allegations of classified documents.
“That’s right, because jury instructions are never finalized until the evidence and testimony is presented. She told him to pack it,” Jarrett continued. “Oh my god, if I had ever made such a stupid request to a judge in any case I’ve ever tried, the judge would have told me to put on my dunce hat and stand in the corner. Because Because the judge doesn’t know how to instruct the jury that all the evidence will be presented. While any other judge would have despised his irreverent arrogance, Judge Cannon said Mr. Smith’s I think he tolerated controversial and abusive behavior.”
Dershowitz, who has criticized Trump’s prosecution in the past, said Smith’s actions appeared to show fear of the judge and potential jurors in the case.
“Jack Smith’s fear is that he might actually get a fair trial in Florida,” Dershowitz said. “He knows he can’t get a fair trial in Washington, D.C., he knows that 95% of voters hate Donald Trump, he knows he can’t get a fair trial in Georgia, he knows he can’t get a fair trial in New York. , this judge is afraid he’ll get an unfair trial.” Fair County, Florida may actually give Donald Trump the right to a fair trial, so he used it to provoke the judge. He is pulling out all the stops and is probably filing a motion to withdraw. ” (Related article: ‘An injustice is being done against him’: Andy McCarthy says defending Trump is ‘hindered’ by gag order)
Mr. Dershowitz also said Mr. Smith was trying to provoke Mr. Cannon into a ruling that could be appealed.
“The Trump people are being accused of trying to delay the trial. That’s nonsense. It’s the prosecutors who are trying to rush the trial,” Dershowitz said. Jack Smith said Americans have the right to a guilty verdict before deciding who to vote for. That’s — almost a confession — that’s actually an admission of election interference. ”
