The Alabama Supreme Court on Wednesday approved the execution of a man convicted of killing a delivery driver who stopped at an ATM.

The justices granted the Alabama Attorney General’s request to approve the execution date for Keith Edmond Gavin, 64. The execution date will be set by Governor Kay Ivey, and the execution will be carried out by lethal injection.

Gavin was sentenced to death for the 1998 shooting death of William Clinton Clayton Jr. in Cherokee County. Prosecutors said Clayton, a delivery driver, stopped at an ATM in downtown Center for money to take his wife out to dinner. The jury voted 10-2 to uphold the death penalty for Gavin. The trial court accepted the jury’s recommendation.

Gavin’s lawyers had asked the court not to authorize the execution, arguing that the state was trying to move Gavin to the “front of the line” ahead of other inmates who have completed their appeals.
