Alabama couple clashes with customer over one-star review of their new ice cream shop

Confrontation Over Ice Cream Shop Review Leads to Charges

In a curious incident, a married couple running an ice cream shop in Alabama is facing allegations of verbally abusing a customer during a confrontation caught on camera, stemming from a one-star review left on their business.

Daniel Smit approached Local Scoop owners Mallary and Ryan Goldman in a McDonald’s parking lot in Bay Minette around three months after he expressed dissatisfaction online regarding an order mix-up by one of their employees, as reported.

On June 7, a visibly upset Mallary reportedly told Smit, who was recording the interaction on his phone, “I hit her on the butt with something and now you think I’m going to slam it on the ground, so I’m angry.”

During the roughly 15-minute video, Mallary launched into a barrage of insults at Smit, while both exchanged remarks about each other’s looks and financial situations. It seemed like neither would back down.

Eventually, she issued a rather pointed warning.

“Please don’t get involved in my business anymore. I’ll definitely do something about it,” she stated.

Ryan, Mallary’s husband, soon arrived on the scene and also escalated the verbal conflict.

Smit, who works as a DoorDash driver, mentioned that after he stopped reviewing the shop in March, he didn’t think much about it until an unexpected meeting with Mallary at a stoplight, which led to their encounter in the parking lot.

At one point, Smit claimed his phone slipped from his hand amidst the heated exchange.

Mallary was charged with harassment and criminal mischief, while her husband faced similar harassment charges.

In the days following the incident, it appeared that both parties were looking to move past the confrontation, with Mallary issuing an apology.

“I apologize to Daniel Smit, his family, and the people of the city I love,” Mallary expressed in a statement.

She added, “I’m ashamed of my actions. I let things build up over time, leading to the incident a few days ago. I can’t change what happened, but I can reflect and learn from it.”

Mallary also noted that personal details about her had been shared online, hinting at a more complex background to the situation.

“There are many layers to this, and while I’m not defending my words, it’s not just about a review of my business,” she said.

On his part, Smit took to Facebook recently, advocating for the dismissal of the charges against Mallary. “I believe social justice has won and there’s no need to go any further,” he stated.

Expressing remorse himself, Smit remarked, “I am ashamed of my actions. If I have upset Miss Goldman, I am truly sorry. Ultimately, we’re all going to move on from this.”
