The U.S. Court of Appeals for the Ninth Circuit has granted an injunction allowing enforcement of California’s ammunition regulations while District Judge Roger T. Benitez’s ruling is being appealed.
Breitbart News reported that Benitez issued a permanent injunction on January 30, 2024. Rose v. Bontablocked enforcement of a California law requiring state residents to undergo background checks before being allowed to purchase ammunition.
On February 5, 2024, the Ninth Circuit stayed the permanent injunction against Benitez, but California appealed Benitez’s decision.

The Ninth Circuit panel consisted of Judge Richard Clifton, a George W. Bush appointee. Consuelo Callahan, George W. Bush appointee. and HA Thomas, appointed by Joe Biden.
Mr. Clifton and Mr. Thomas voted to maintain Mr. Benitez’s permanent injunction, while Mr. Callahan opposed it.
California Rifle & Pistol Association reacted Send it to the stay with a statement that states, “The 9th Circuit does 9th Circuit things.”
