Any rule changes must be approved by the Arkansas General Assembly’s Legislative Committee. If the policy goes ahead, all previously issued licenses and IDs with the “X” mark will remain valid until their existing expiry date, the ministry said. Residents must update their gender when renewing their driver’s license or ID card.

At least 22 states and the District of Columbia allow “X” as an option for licenses and IDs. There are more than 2.6 million valid driver’s licenses in Arkansas, 342 of which are marked with an “X.” The state has approximately 503,000 IDs, 174 of which have an “X” designation.

DFA Secretary Jim Hudson said the canceled policy is not supported by state law and has not gone through the public comment process or legal review required by state law.
