Trial Unfolds over Musk and OpenAI Dispute

OAKLAND, Calif. — Lawyers representing Elon Musk and OpenAI delivered concluding arguments in a groundbreaking trial on Thursday, one that has the potential to significantly influence the direction of artificial intelligence.

Musk, known as the world’s richest individual, co-founded OpenAI back in 2015, a company credited with developing ChatGPT. He filed a lawsuit in 2024 that accuses OpenAI CEO Sam Altman and a senior official of turning the organization into a profit-driven enterprise contrary to their initial nonprofit intentions.

The verdict of this trial could shift the dynamics of power within the AI sector, with rising concerns about its economic and societal impacts, as well as its implications for humanity. The inquiry into Altman’s leadership comes at a critical juncture for OpenAI and its competitors, including Musk’s own AI venture and Anthropic, which consists of several former OpenAI leaders.

All three companies are preparing for initial public offerings that could break records. Musk is seeking compensation and a restructuring of OpenAI’s business, along with calling for Altman’s removal from leadership. A victory for Musk might complicate OpenAI’s plans to go public.

Key Timing Considerations

A crucial task for the jury is determining whether Musk filed his lawsuit within the allowable timeframe. Much of the testimony has explored OpenAI’s formative years, but there’s a strict period during which Musk can allege breaches of charitable trust and unjust enrichment.

OpenAI maintains that Musk has delayed too long, suggesting he cannot claim damages that happened prior to August 2021.

The judge indicated in a recent filing that if the jury concludes Musk didn’t file on time, she would likely uphold that finding and issue a verdict in favor of the defendants.

If the jury determines the suit was timely, they must then consider whether OpenAI violated a “charitable trust” and if its executives unjustly benefited at Musk’s expense. Additionally, for co-defendant Microsoft, they must assess whether the tech company aided the alleged violation.

Trust Issues and Credibility

While Altman and Brockman attended court on Thursday, Musk was in China with former President Donald Trump and other tech executives. Musk’s attorney, Steven Molo, expressed regrets over Musk’s absence.

During his closing pitch, Molo focused on calling Altman’s integrity into question, using testimony labeling him a “liar.” He emphasized, “If you cannot trust him, if you don’t believe him, they cannot win. It’s that simple.”

Five witnesses who made such claims included Musk, co-founder Ilya Sutskever, and other OpenAI officials.

Because no formal contract was signed by Musk, Altman, and Brockman establishing a charitable trust breached by OpenAI, Musk’s side argued for jurors to consider various communications and OpenAI-related materials as indicative of such a trust.

A Financial Aspect

In an abrupt moment during the trial, U.S. District Judge Yvonne Gonzalez Rogers criticized Musk’s counsel for implying that Musk wasn’t pursuing monetary compensation. Although Musk previously dropped claims for personal damages, he still seeks an unspecified amount aimed at supporting OpenAI’s charitable initiatives.

Judge Rogers urged Molo to clarify his statements regarding “billions of dollars” Musk is after, leading both parties to agree on a correction for the jury.

OpenAI’s Defense

OpenAI’s attorney, Sarah Eddy, countered by suggesting Musk is the one misrepresenting events around the company’s nonprofit intentions and his fallout with co-founders. She argued, “Mr. Musk has come nowhere close to making that case,” pointing out that Musk had previously discussed his children inheriting control of the organization.

“He wanted dominion over AGI,” Eddy asserted, referring to advanced AI tech with superior capabilities. “That’s why this was such a high stakes conversation.”

Protests Erupt Outside the Courthouse

Outside, demonstrators criticized both sides, labeling them as billionaires who exploit the environment and public well-being, proclaiming the AI industry as a threat to humanity. Signs conveyed sentiments like “Stop replacing healthcare workers with chatboxes!”

Protestor Saru Jayaraman stated, “We’re all losing. Who’s really winning? The two of them,” referencing Musk and Altman.

Peace activist Phoebe Thomas Sorgen echoed the need for a global ban on AI, expressing skepticism about both parties’ motivations, suggesting they prioritize profit over humanity.
