New Rule Grants DHS Authority to Charge for Federal Property Crimes
In response to ongoing riots at immigration facilities, officials from the Department of Homeland Security (DHS) now have expanded powers to charge individuals with crimes against federal property.
On Wednesday, DHS shared an exclusive statement, revealing a rule named “Protection of Federal Property.” This rule gives law enforcement officers the ability to take action against rioters. For instance, officers can now arrest individuals who are masked and committing crimes, along with those using drones or other unmanned aerial vehicles to damage federal property, interfere with government technology systems, obstruct federal employees in their duties, engage in disorderly conduct, or threaten violent acts.
“Under President Trump, we will not tolerate repeated violence by Antifa and other domestic extremists directed at federal property and law enforcement,” DHS spokesperson Tricia McLaughlin stated, emphasizing that “law and order will prevail.”
The Trump administration cited federal law to justify this move. The DHS is authorized to safeguard “buildings, grounds, and property” owned by the federal government, and under the newly instated rules, DHS employees can pursue charges irrespective of where a crime occurs as long as it affects federal property and the people on it.
Originally, DHS intended for this rule to be implemented in January. However, escalating security threats prompted them to expedite the process.
“DHS is utilizing every means available to ensure the safety of law enforcement agents. They are facing increased violence and unlawful activities across many federal facilities,” McLaughlin explained. She pointed out that there have been alarming instances of violence against officers, including shootings, vehicular confrontations, and physical assaults.
DHS referenced two shootings at Texas Immigration and Customs Enforcement (ICE) facilities in June and September as significant incidents. At least 21 individuals are facing charges related to an ambush at an Alvaredo facility in July, which almost resulted in a local officer being shot. Additionally, a second shooting in Dallas involved a detainee who died, with the suspect indicating a focus on targeting ICE agents.
Since Trump’s return to office, left-wing protests outside ICE facilities in locations like Portland, Oregon, have resulted in numerous arrests for assaulting federal officers and other violent actions. In light of these protests, the president announced intentions to deploy the National Guard to safeguard ICE.
