The Biden administration’s Justice Department is threatening to sue over Iowa’s new immigration law, according to a Thursday letter obtained by the newspaper. des moines register.
It was signed by Iowa Gov. Kim Reynolds (Republican) in April. Senate File 2340 A law is enacted that gives state police the power to arrest and deport certain illegal aliens, blaze news Previously reported. It is scheduled to come into effect on July 1st.
Under the new law, illegal immigrants can be charged with an aggravated misdemeanor if they have an outstanding removal order, have been previously deported, or are barred from entering the country. According to the law, undocumented immigrants with prior felony convictions or previous deportation orders related to drug crimes or crimes against persons may face felony charges. Additionally, the new law gave judges the power to allow illegal immigrants to leave the country instead of facing state charges.
Reynolds signed the bill because “the Biden administration is failing to enforce our nation’s immigration laws, putting the protection and safety of Iowans at risk.”
“People who entered our country illegally are breaking the law, yet Biden refuses to deport them. This bill will force Iowa law enforcement to do things he doesn’t want to do,” Reynolds said. It gives them the power to implement immigration laws that are already in place.”
The new law is as follows Texas Senate Bill 4is currently tied up in the court system as a result of a lawsuit brought by the Department of Justice.
The department warned Iowa on Thursday that it would challenge the new law if state officials allow it to go into effect.
In a letter obtained by the Des Moines Register, Assistant Attorney General Brian Boynton told Reynolds and Attorney General Brenna Byrd that the Department of Justice “will not pursue litigation to enforce the supremacy of federal law and prohibit SF 2340.” I’m going to wake him up.”
“SF 2340 supersedes federal law and violates the U.S. Constitution,” Boynton argued, arguing that the law “effectively creates a separate state immigration system.”
The Justice Department also argued that the law violates the Immigration and Nationality Act.
To avoid legal action, Iowa must suspend the bill until May 7.
“The only reason we had to pass this law is because the Biden administration refuses to enforce the laws that are already in place,” Reynolds told the Des Moines Register.
“I have a duty to protect the people of Iowa. Unlike the federal government, I will respect and enforce the rule of law,” he added.
Byrd also supported the governor’s decision to enact the new law, noting that “Iowa is not backing down.”
“Biden has not only refused to enforce federal immigration laws and secure our borders, but he has also threatened to block states like Iowa from enforcing their own laws,” Byrd said. “Our message to Biden is this: Iowans will not back down and stand by while our state’s security is at stake. If Biden refuses to stop border violations and keep our communities safe, Iowans will stand by. The state will do the job for him.”
