President Joe Biden has ordered a halt to asylum applications unless applicants arrive through official ports of entry, but the order will be lifted if immigration arrests fall to fewer than 1,500 per day.
In December 2023, monthly illegal border crossings soared to a record high of nearly 250,000.
“The Department has determined that the 1,500 encounters threshold is an appropriate indicator that the border security and immigration systems are no longer over capacity and that the measures adopted in this rule are not necessary to address that situation,” the rule states.
A CBS News review of internal Department of Homeland Security data found the seven-day average of immigration apprehensions at ports of entry has fallen to 1,650 and could soon reach a threshold.
The crackdown order will end after 14 days if Homeland Security Secretary Alejandro Mayorkas determines the threshold has been met.
But a senior US Customs and Border Protection official told CBS the agency did not expect to reach that threshold.
“We are not yet at a point where we will be below 1,500 in a day or a few days,” the official was quoted as saying.
