Last August, Immigration and Customs Enforcement (ICE) officials indicated that the agency suspended the 287(g) program without explanation in January 2021, after President Biden took office, according to IRLI.
The 287(g) program allows local law enforcement agencies to enter into agreements with ICE to seamlessly identify illegal aliens who have committed crimes and turn them over to federal agents for arrest and deportation.
In September 2023, IRLI filed a Freedom of Information Act (FOIA) request with ICE requesting all internal communications regarding the agency's suspension of the 287(g) program. The federal government is supposed to respond to FOIA requests within 20 business days, but as of this week ICE officials had not responded to the requests.
IRLI's lawsuit seeks to force ICE officials to release internal communications explaining why ICE suspended the 287(g) program.
“Increased collaboration between ICE and local law enforcement is critical, and the administration understandably wants to limit that effort in order to make our communities safer,” IRLI Secretary of State Director Dale Wilcox said.

Before Biden's DHS suspended the 287(g) program, 23 new agreements between local law enforcement and ICE were scheduled to go into effect but were canceled. Currently, ICE has 287(g) agreements with approximately 140 law enforcement agencies across the United States.
“The Biden administration claims to be the most transparent in history, when in fact it repeatedly attempts to change immigration laws without Congressional approval and hides evidence of its wrongdoing from the American people. It's ironic,” said Matt O'Brien, IRLI research director.
“IRLI wants to bring the details of the 287(g) hold to light, even if we have to fight for it,” O'Brien continued.
