Bryan Kohberger’s defense team is trying to create “illusions” for future ju umpires with new efforts to cast specific evidence, a former FBI special agent said.
Kohberger is charged with first-degree murder in the deaths of four students at the University of Idaho, including 21-year-old Kaylee Goncalves. Xana Kernodle, 20; Madison Morgen, 21; Ethan Chapin, 20; The former Washington State University student has been charged with felony robbery.
At the April 9 hearing, Judge Stephen Hippler issued several sentences on allegations filed by the defense. Hippler partially agreed to motions from his defense attorneys that would have prevented prosecutors from using words such as “psychopath” and “sociopath” during the trial.
However, he warned that the defense’s demands are similar to seeking “an order that the state will not commit fraud by the prosecutor.” Hippler said the term “murderer” could be used during the closing discussion, but terms such as “sociopath” and “psycho” cannot be used unless expert reviews determine that these words describe Coberger.

The doctor, who is being used as a witness by the defense, agreed to hand over her findings about Brian Coberger’s psychological state following the move to eliminate the death penalty based on the autism diagnosis of former Washington State University students.
Kohberger’s defense team also sought “inflammatory evidence” that would be excluded from trial, including the excessive use of crime scene photographs, but Hippler said he hopes the evidence reflects the “brutally and horrifying” nature of the murder.

At the April 9 hearing, the defense attorney promoted audio from 911 calls made by the victim’s roommate and from 911 calls that were excluded from trial. Hippler said he would only consider airing the edited version of Call during the trial, but he said it is likely that he would allow 911 call audio to be played.
Hippler said he would control several moves after the hearing.
Former FBI special agent Jonathan Gilliam told Fox News Digital he believes Kohberger’s defense team is focused on creating doubt in future ju umpires.
“It’s important to make that happen. [the defense] It doesn’t focus on his guilt or innocence. They focus on showing or creating the illusion that the prosecution does not have a strong enough case to convict.

“[The defense is] “We are trying to influence the courts to create barriers or hurdles for the prosecution,” he added.
During the April 9 hearing, defense attorney Anne Taylor attempted to argue that the prosecution was intentionally slow discovery, but later admitted that all requests from the defense were provided.

Gilliam said this was another attempt from Taylor.
“They were able to stop it again and again,” Gilliam said of Taylor’s court tactics. “And I think they’re trying to do it. To keep enough distance where they can get a more sympathetic ju judge, they hope that they can throw away some of the evidence because it may not be as transparent as the prosecutors would like.”

“What they’re doing is throwing everything they can hostile to the wall and they hope something sticks,” Williams said. “But there’s overwhelming evidence that, not only will Brian Coberger be in the house, but he’s likely a murderer of these four young students.”
