The California Senate has passed a bill that would essentially ban parents from being informed about their biologically impossible children’s gender transition, aligning with Gov. Gavin Newsom’s (D-Calif.) belief that parents have no right to know if their children are “transitioning.”
Lawmakers believe the bill (AB-1955, “Supporting Academic Futures and Educators for Today’s Youth Act”) would provide protections for parents to “forcefully remove” their children. summary The bill includes:
This bill would prohibit school districts, county offices of education, charter schools, and state special education schools, as well as members of the boards or agencies of these educational agencies, from enacting or enforcing policies, rules, or administrative regulations that require employees or contractors to disclose information related to a student’s sexual orientation, gender identity, or gender expression to any other person without the student’s consent, except as otherwise required by law. This bill would prohibit employees or contractors of these educational agencies from being required to make such disclosures, except as otherwise required by law. This bill would prohibit employees or contractors of school districts, county offices of education, charter schools, and state special education schools, as well as members of the boards or agencies of these educational agencies, from taking retaliation or adverse action against an employee because the employee has assisted a student in the exercise of certain rights, work activities, or the provision of certain instruction, as provided.
In other words, parents are left in the dark. “Policies that force ‘coming out’ without a student’s consent deny LGBTQ+ youth and their families the opportunity to build trust and have these conversations when they are ready,” the bill states.
Further background information from the California Legislative LGBTQ Caucus: Assert The bill is about student “privacy,” arguing that “transgender students have the right to keep their gender identity private under California’s anti-discrimination laws, as well as federal and state laws.”
“Despite courts recognizing that students have the right to keep their personal information private, a growing number of school boards continue to propose mandatory outing policies,” the report continues.
This lines up well with Newsom’s position, as he has publicly dismissed parents’ concerns about California’s policy that bars schools from notifying parents if their child expresses a desire to “change” their gender.
