CNN legal expert Elie Honig fact-checks President Joe Biden’s denial of key established facts. Special Counsel Robert Hur’s investigation.
At a news conference late Thursday, Biden denied sharing classified information with ghostwriter Mark Zwonitzer. Shout out to NBC News correspondent Gabe Gutierrez He claimed that he had dared to ask Mr. Xu about the charges and concluded that Mr. Xu did not violate the law.
Mr. Honig was surprised because this claim was not true.
“Here are the facts,” Honig said later on CNN. “After resigning as vice president, Joe Biden kept classified documents…marked as classified, top-level, top-secret SCI. It was related. He knew it. He knew it. After he left office as vice president, he was caught on tape telling his autobiographer, “The classified documents are in the basement.” . he knew that. ”
“That’s what struck me about Joe Biden’s statement,” Honig exclaimed.
Honig, a former federal prosecutor, explained:
There are two things he said that are completely contrary to what Robert Herr discovered. First, Joe Biden says, “I did not act intentionally.” Deliberate simply means voluntarily, intentionally. Now, his second sentence in this whole summary says, “President Biden knowingly retained and disclosed classified material.” The facts here show that it was intentional. he knew. he talked about it. And the second thing he says is that he doesn’t “disclose confidential documents to ghostwriters.” The third page says he did so. “Mr. Biden shared information with the ghostwriter, including some of the classified information contained in these notes,” it said.
Later in the broadcast, Honig explained why Biden’s lawsuit would help Trump both politically and legally.
“Two things that will help. One is just the atmosphere, right? We’ve all seen the photo of papers strewn in the toilets on stage at Mar-a-Lago thousands of times. “There are now two similar photos in this report,” he began.
“But this is the technical way that Donald Trump’s team is trying to take advantage of this. Mark my words,” Honig promised.
Honig said Trump “has grounds” to file a motion for selective prosecution in his classified documents case because Biden “did essentially the same thing” that Trump is accused of. That’s what it means. But Honig noted that such motions are difficult to win.
