Court Rules Deported Illegal Migrant Can’t Be Brought Back to the U.S.!

Attorneys from the Department of Justice (DOJ) contend that federal judges cannot compel the Trump administration to facilitate the return of MS-13 gang members who have reportedly been wrongly deported to El Salvador.

DOJ lawyers informed the 4th U.S. Circuit Court of Appeals “Immediately.” PauseOrders issued by U.S. District Judge Paula Sinis, as reported by CBS News.

According to Breitbart News, Sinis, who was appointed by former President Barack Obama, has been notified that Kilmer Armando Abrego Garcia, an undocumented immigrant from El Salvador, will be “from 11:59pm on Monday, April 7, 2025.”

The DOJ’s attorneys claimed, as noted by CBS, that “judicial commands that compel executives to engage with foreign powers in specific manners, not to mention enforced actions by foreign sovereigns, are constitutionally intolerable.”

Garcia’s legal representatives “urged the court to reject the government’s request” in response to the DOJ’s plea for the court to halt Kinis’ directive:

Abrego Garcia’s counsel on Sunday requested the court dismiss the government’s claims, asserting that their arguments are likely to succeed on merit. They also contended that the government’s assertion that an order to return Abrego Garcia was “not feasible or suitable.”

Erez Roubeni, serving as the deputy vice-director of the DOJ immigration litigation office, reportedly has been placed on indefinite leave following his request. I was asked as per the Trump administration’s deportation of Garcia New York Times.

As stated by Breitbart News, Garcia “illegally entered the United States in 2011,” but news outlets referred to him as “a father in Maryland with protected status.”

This week will spotlight Kilmer Armando Abrego Garcia, a migrant from El Salvador. He was sent back despite judicial rulings in 2019 that prohibited his deportation in one area, El Salvador.

Garcia has been expelled to El Salvador and is seeking assistance in suing the federal government to be allowed back into the United States.

The Trump administration stated that Garcia’s deportation resulted from “administrative errors” and “monitoring.” White House press secretary Caroline Leavitt disclosed that the administration is “engaged in human trafficking” and “has credible intelligence.”

“The administration holds the stance that this individual, who has been sent back to El Salvador, will not return to our country, is a member of the dangerous and ruthless MS-13 gang. “In reality, there is credible intelligence demonstrating that this individual is involved in human trafficking and was indeed part of the ruthless MS-13 gang, which the president classified as a foreign terrorist organization.”
