Appeals Court Rules Military Transgender Ban is Unconstitutional

A panel from the U.S. Court of Appeals for the D.C. Circuit recently ruled, with a split decision, that Army Secretary Pete Hegseth acted outside constitutional boundaries by imposing a ban on transgender service members.

Two of the judges on the panel granted a preliminary injunction, stating their disapproval of the Department of Defense’s attempts to prevent transgender individuals from serving in the military.

Judge Robert Wilkins pointed out that the government’s rationale for enforcing the ban, which focused primarily on gender dysphoria, lacked validity. He suggested that the policy stemmed, at least partially, from an inappropriate aim to harm transgender individuals who are not politically favored.

In agreement with Wilkins, Judge Judith Rogers also found the order likely violated the Equal Protection Clause of the Constitution.

Interestingly, both Wilkins and Justice Justin Walker consented that the Trump administration could still exclude transgender plaintiffs from military service as the legal proceedings continue.

Shortly after taking office for his second term, President Donald Trump issued an executive order indicating that military standards of readiness and integrity do not align with “medical, surgical, and mental health” issues related to gender dysphoria.

Fast forward to February 2025, when the Department of Defense implemented additional regulations impacting transgender personnel.

In his statement, Wilkins highlighted that the plaintiffs, collectively, have earned over 80 military awards and have served for a total of 130 years, challenging the legitimacy of the ban.

He also noted that the Trump administration had conceded there was a lack of evidence to suggest that individuals with gender dysphoria lack honesty, integrity, or humility.

As of December 2024, around 4,200 soldiers had been diagnosed with gender dysphoria, according to defense officials.

It’s worth mentioning that Justice Justin Walker was appointed by Trump in 2020, while Wilkins and Rogers received their nominations from former Presidents Barack Obama and Bill Clinton, respectively.
