Brito was recently charged with petty theft and possession of stolen property after allegedly trying to steal children’s clothing and perfume from Macy’s.

Mr. Bragg’s office requested bail of $10,000 cash, but a Manhattan judge chose to release Mr. Brito after his arraignment Saturday.

“I’m going to issue a warrant and set your bail so high that you won’t be able to leave the country.”

Bragg’s office proposed that Yeoman Rebellon, 24, be sentenced to two years in prison if he pleads guilty to second-degree assault. At the time of the attack, Rebellon already had two outstanding cases for assault and robbery.

According to the newspaper, Edgaris Vegas, 20, has not yet received a plea deal.

None of the suspects have yet taken plea deals.

Judge Laura Wood told Brito on Tuesday: “I am outraged that Mr. Brito was rearrested and charged with petty theft while he was not working on this case.”

“I really want to put you in jail right now. I’m telling you right now, if between now and the end of this case I find out that you’re rearrested for any reason, will issue a warrant and set your bail so high that you will not be able to leave,” Wood continued. “If you walk on an overpass or jump a turnstile or anything, and I have to issue a warrant, you won’t see the light of day until this case is over.”

Surveillance footage of the January attack showed a group of illegal immigrants kicking and punching two police officers in the head and body as they tried to detain a suspect. The group of men fled the scene on foot.
