Democrats File Lawsuit Against Trump’s Executive Order on Voting

Top Democratic leaders in Congress, along with their campaign organizations and allies, have initiated legal action against President Donald Trump and his administration regarding an executive order that was signed recently. This order expands federal oversight in elections.

The lawsuit was filed on Thursday in U.S. District Court in Washington, D.C., aiming to halt Trump’s executive order from Tuesday, which targets mail-in voting and voter eligibility. This comes as Senate Republicans debate the Protection of American Voter Eligibility Act (SAVE).

Schumer, Jeffries, and committee chairs stated in a joint announcement, “The American people are fed up with the Republican Party’s policies that inflate prices and damage healthcare. We are determined to reject it.” They further asserted that Trump is attempting to undermine the election by making it more challenging for various groups—seniors, individuals with disabilities, military members, and rural communities—who depend on mail-in voting. They described the executive order as “blatantly unconstitutional.”

They emphasized, “We are taking action to challenge President Trump’s executive order to safeguard the right to vote and ensure that all eligible Americans can express their opinions on election day.”

Meanwhile, Trump has cautioned Republicans that failing to pass the SAVE America Act could lead to significant losses in the forthcoming midterm elections, especially with unified Democratic resistance in the Senate.

The executive order illustrates Trump’s approach to take unilateral action amid the current political circumstances in Congress. It mandates using government databases to establish a federal list of citizens, which must be shared with states prior to elections. Additionally, the United States Postal Service (USPS) will now oversee mail-in voting procedures, requiring voters to register with the USPS to obtain mail-in ballots.

The order also allows the USPS to reject ballots from those not on the approved list and imposes new federal rules concerning ballot envelope designs and processing.

Democrats assert the order is unconstitutional for a multitude of reasons. They claim it undermines states’ authority over elections, violates the principle of separation of powers, infringes on privacy rights, and risks disenfranchising millions of voters. They contend that Trump lacks the authority to enforce such extensive changes to the electoral process across the nation.

“If permitted to proceed, the President’s actions would significantly disrupt the constitutional balance between state and federal authority,” they argued in their lawsuit.

The White House has not yet responded to inquiries regarding this matter.
