Sen. Dick Durbin (D-Ill.) on Wednesday killed a Republican-backed bill that would have automatically detained illegal aliens accused of violent crimes.

Ernst sought unanimous consent for Sara’s Law, a policy that allows legislation to be passed without further debate or committee work. The senator said in a floor speech that victims such as Sarah Root and Laken Riley would not have been killed by illegal aliens if the suspected killer had been held in prison for a previous crime. Ta.
But unanimous consent can be overridden by just one negative vote. And Durbin stipulated there would be no votes to serve illegal aliens.

“It simply requires ICE to detain illegal immigrants who are charged with killing or seriously injuring another person and who would otherwise be deportable,” Ernst explained. This could prevent suspects from committing other crimes while their previous cases are going through the system, she added.
But Durbin said automatically detaining people in the country illegally “deprives immigrants of the due process that everyone deserves.”
Durbin did not explain how illegal border crossers should be considered legal “immigrants” who deserve due process.

Ernst’s bill is named after Sarah Root, who was allegedly murdered at the age of 21 by Edwin Mejia, an illegal immigrant. Mejia was released on bail despite the murder charge and fled the country to avoid having to stand trial.
The senator noted that under President Obama’s November 2014 rule, ICE refused to detain Mejia “despite his history of repeated driving violations and missed court appearances.”
Ernst also pointed out that the extensive “catch-and-release” policies that Biden has adopted since taking office have weakened immigration and law enforcement, putting all Americans at risk. The senator pointed to what happened to Laken Riley, a 22-year-old Georgia co-ed who was found murdered on the University of Georgia campus. The suspect in her murder, Jose Ibarra, was previously in federal custody but has been released.
