Dutch climate activists are preparing to take legal action against energy companies, aiming to halt the development of new oil and gas projects.
A letter from the Dutch nonprofit Mariede Fencey addressed to Shell outlined plans to pursue legal avenues, as the company is currently progressing with 700 projects that are expected to exacerbate carbon emissions despite ongoing climate change mitigation efforts.
This new initiative comes six months after Shell managed to reverse a previous court ruling that had favored a Green Group, which had called for Shell to reduce its emissions.
The activists are now waiting for a decision from the Dutch Supreme Court regarding their argument that Shell should cut its emissions by 45% to align with the Paris Climate Agreement.
Donald Pol, director of Milieudefensie, remarked that the rule of law encourages them to “take the challenge back to court.”
He expressed concern over the current climate crisis, stating, “At a time when the climate crisis continues to rage due to actions from companies like Shell, new oil and gas fields are simply too numerous.”
The court previously indicated that Shell could be compelled to take steps beyond existing laws to protect the environment, but noted that it isn’t realistic to demand a specific percentage reduction in emissions.
Instead, the group advocates for a ban on new oil and gas fields rather than setting emission goals.
“We cannot just sit by as Shell follows a fossil fuel path. Shell remains fully committed to new oil and gas projects despite scientific warnings of serious consequences. This is a critical moment to address the climate crisis,” Pol stated.
A spokesperson for Shell acknowledged receipt of the letter but emphasized that no lawsuit has been initiated yet.
“As we’ve mentioned repeatedly, what Milieudefensie is proposing doesn’t support the energy transition. Our society still relies on oil and gas for heating and transportation, so any successful transition will need collaboration among governments, businesses, and consumers.”
This lawsuit follows a history of legal engagements between Shell and climate activists, including the resolution of a $2.1 million lawsuit against Greenpeace last year after a protest involving activists boarding an oil rig.
Earlier in 2023, Shell also successfully quashed a lawsuit filed by the Environmental Law Charities when a London High Court denied permission to proceed with the case against the company.
