EPA Aims for Permitting Speed and Transparency

The Environmental Protection Agency (EPA) is making strides to enhance the permitting process and ensure greater transparency in how it handles comment letters, as reported by The Daily Caller News Foundation.

On Wednesday, the EPA announced a new memorandum that seeks to foster “common sense, transparency, and clarity” in its reviews of other agencies’ environmental impact statements (EIS) under relevant environmental laws.

Under the Clean Air Act, specifically Section 309, the EPA is responsible for reviewing all draft EISs prepared by federal agencies. To improve access to this information, the agency plans to make these reviews available publicly through its EIS database.

A release from the EPA mentions concerns that past administrations have misused this process, often leading to “confusing and costly delays” due to overly extensive comment letters that exceed the agency’s statutory authority. The agency suggests that such misuse has sometimes stymied unfavorable projects.

Additionally, the EPA claims that during President Biden’s administration, comment letters occasionally focused on politicized objectives, diverging from the agency’s core responsibilities.

For instance, it was noted that under Biden, a lengthy letter was submitted to the Interior Department that referenced widely disputed concepts regarding the social costs of climate change in relation to coal mining projects, which are crucial to the nation’s energy needs.

David Fotouhy, the EPA Deputy Administrator, stated, “EPA’s environmental expertise is most beneficial when provided early and clearly in the process.” He emphasized that this memo should enable the agency to provide useful feedback to project sponsors sooner, which could help accelerate project timelines while avoiding unnecessary taxpayer spending.

The primary goal of the EPA’s review process is to ensure timely and well-informed decision-making. The agency encourages federal entities to use its expertise to identify potential environmental issues in proposed projects.

Furthermore, the memo outlines that feedback regarding project impacts should align with the duties imposed by environmental law, drawing on the EPA’s specialized knowledge.

Looking ahead, the Trump administration is also focusing on expediting federal permitting processes, having outlined plans for a “permitting technology action plan” aimed at modernizing environmental reviews for various infrastructure projects.

The involvement of the EPA in this plan aims to streamline the permitting process, making it less arduous and more predictable for companies investing significantly in the U.S.
